In the event that the Product(s) fails to perform as acceptable at any time during the Warranty Period, Minetec will, at its option: a. replace the Product(s) or supply equivalent Product(s) b. pay the cost of replacing the Product(s) or of acquiring same Product(s) or d. pay the cost of having the Product(s) repaired. You are also entitled to have the Product(s) repaired or replaced if the Product(s) fail to be of acceptable quality and the failure does not amount to a major failure. All warranty claims in respect of a Service(s) must be authorized in writing by Minetec before any repair, support, maintenance or technical assistance is undertaken. Product(s) supplied by Minetec which is not designed or manufactured by Minetec (Minetec will, however, bear plausible assistance to the user of such product(s) to enable them to pursue the product(s) stuffed gain of any warranty given by the manufacturer) or b. any failure, to the extent that the failure is not a failure of the Product(s) or Service(s) to perform in accordance with its specifications or c. any failure, if the Product(s) or Service(s) has been modified or operated outer of Minetec’s specifications or d. ravage to the Product(s) or following ruin behind a Service(s) due to outer causes including accidents, problems with electrical power, mechanical or environmental conditions, usage not in accordance with Product(s) or Service(s) instructions, misuse, neglect, alteration, repair or improper testing or e. any costs associated with mend or replacement of the Product(s) incurred by users, including labor, installation or other costs incurred by users and in particular any costs relating to the removal or replacement of the Product(s) that is attached or otherwise affixed to any other object or f. replacement or fix of any consumables (including batteries and cables), or lost parts or accessories unless these were the marred item supplied as portion of a Service(s) or g. service and promote of any software operating system or application installed on any Product(s), except to help in restoring the Product(s) to its factory default settings or h. any third party technical encourage or maintenance of the Product(s) where such third parties are not authorized by Minetec to carry out such work support. This warranty replaces all other warranties in respect of the Product(s) and Service(s). 1.25 Products means products, Software and or components to be manufactured or imported by ardor otherwise procured and supplied by Minetec to or for the Purchaser, as specified in an Order. 1.30 Services means services to be supplied by Minetec to the Purchaser, as specified in the Order, but specifically excludes any form of consulting services. Unless otherwise agreed in writing, they do not form segment of the contract between Minetec and the Purchaser or any other contract between Minetec and the Purchaser for the supply of the Products. Delivery to such deposit shall in all respects be deemed to be delivery of the Products to the Purchaser. Failure of Minetec to deliver any installment shall not entitle the Purchaser to cancel the balance of the Order. 5.7 Risk of ruin to or destruction or loss of the Products shall pass to the Purchaser when property in the Products passes to the Purchaser on whichever shall occur first of the following: (a) in accordance with clause 5.10 (b) when Products are dispatched from Minetec’s Premisesor (c) when delivery is effected or deemed to have been effected lower clause 5.1 or 5.2. 9.3 Claims related to delivery, including concise delivery and damaged Products, must be received in writing within 7 days of delivery for Minetec’s consideration. 30.5 The Purchaser represents that it has not been convicted of or pleaded guilty to a criminal offense, involving fraud or corruption that it is not now, to the best of its knowledge, the sub
